These General Terms and Conditions of Sale regulate the online shopping service that will allow the contracting of products and services offered on the Website https://tienda.agu-punt.com/, owned by Agupunt S.L.

Individuals who wish to use the online shopping service of the Website must be a registered Customer, which is acquired by completing the forms provided for this purpose. However, the option to start purchases as a “guest” is offered, but the order cannot be finalized until registration is completed. Whether the purchase is made as a registered Customer or as a guest, the use of this online sales service implies adherence to the General Terms and Conditions of Sale in the version published at the time the website is accessed.

INFORMATION ABOUT PRODUCTS FOR SALE

The descriptions of the products displayed on the Website are based on information provided by Agupunt S.L.’s suppliers. The photographs of the products and the trade names, brands, or distinctive signs contained on the Website are of the actual products offered for sale, to provide the most truthful and accurate information about the product and its characteristics. However, it should be noted that the description is not exhaustive. Furthermore, it should be taken into account that there may be occasional variations in product colors, as photographic reproduction may not be entirely accurate to the shade of natural colors.

PRICES AND OFFERS

Prices for items displayed on the Website appear below their commercial name, including Value Added Tax (VAT included). Below this price, in parentheses, will appear the value of the taxable base of the item in question (Price without VAT).

Different types of offers or promotions will be periodically published on the website, applicable to all offered items or only to certain products, as the case may be.

The price appearing under each item represents the final price of the product, to which the corresponding discounts have already been applied in each case. For these purposes, the original price is indicated crossed out, and the current reduced sales price is highlighted.

If you have a special rate or a discount coupon, prices will be updated once the corresponding code is entered in the enabled section (Promotional Code).

In no case are discounts cumulative, unless otherwise indicated.

The prices applied to items in the online store are exclusive and do not necessarily correspond to the prices applied to the same items in our physical establishments.

SHIPPING COSTS

If the order amount is over 95€ (VAT not included), no shipping costs will be charged for destinations in mainland Spain. For shipments by Post to Ceuta, Andorra, and the Canary Islands, 12.90€ (VAT included) will be charged. Rest of Europe 150€ (VAT not included).

Shipping costs for orders destined for the Balearic Islands, Canary Islands, Ceuta, Melilla, or international destinations will be calculated in each particular case based on the weight and volume of the shipment, as well as the chosen transport type, which will be communicated to the Customer as soon as possible for approval. Where applicable, customs duties will be borne by the customer.

Damage to the shipment: Agupunt is not responsible for damages suffered by shipments. If you receive a damaged shipment, refuse to accept it until the carrier notes “Damaged Material” on the delivery note and notify Agupunt as soon as possible. It is important to inspect the merchandise as soon as it is received, as any anomaly in the shipment must be claimed from the transport agency within 24-48 hours of receipt of the merchandise.

Any stock breakages will be sent later with shipping costs borne by Agupunt S.L. except for international or national shipments with customs.

AVAILABILITY

In the event that the requested product is not available, the Customer will be informed, as soon as possible, of the total cancellation or partial shipment of the order. The lack of availability of one or more requested products does not imply the cancellation of the entire order, but rather will generate a partial shipment. Only the portion of the order that is delivered will be invoiced. If, due to the cancellation of unavailable products, the Customer wishes to return the product already served, they must follow the instructions detailed in the Returns section.

Agupunt S.L. reserves the right to modify, update, or delete any of the contents of this website, at any time and without prior notice.

PAYMENT METHODS

You can pay for your orders by choosing one of the following options:

Cash on delivery (direct cash payment to the carrier). This payment method can only be applied to orders under 1000€.

Bank transfer. When selecting bank transfer as the payment method, you will receive an order confirmation email to the address you registered with on the website, summarizing the requested items and providing the account number for the deposit. As soon as we receive proof of payment, we will proceed with the shipment of the merchandise. The transfer must be made within a maximum of 10 calendar days from the date of purchase. If for any reason, it is not made after these 10 days, we cannot guarantee the availability of the products. All banking commissions and corresponding expenses generated by the transfer are entirely borne by the sender.

Credit Card. Payment by credit card will be made after the order has been placed through the secure payment gateway of Banco Santander. In the event that the POS terminal reports a card denial, the order will be automatically canceled, informing the customer online of the cancellation. If any of the items in an order are out of stock or have any incident at the time of dispatch, the corresponding amount will be refunded to the credit card within a period not exceeding 10 days.

ORDER PLACEMENT

When the customer finalizes the order with the acceptance of the general terms and conditions of sale and the corresponding confirmation of the purchase process, Agupunt S.L. will send an email to the address indicated by the customer, confirming all purchase details.

DELIVERY TIME AND PLACE

Agupunt S.L. will deliver the product in perfect condition to the address indicated by the Customer in the “Shipping Address” form.

Orders received before 13:00 will be processed on the same day and sent by courier, to be received at their destination within 24/48 hours anywhere in Peninsular Spain. For shipments destined for the Balearic Islands, the delivery time is 48/72 hours.

The delivery time for other destinations may vary depending on the chosen shipping method.

Delivery times may be extended in exceptional circumstances, in which case the customer will be notified as soon as possible.

At the time the order leaves our warehouses, the Customer will receive an email indicating the transport agency that will deliver their shipment.

If the Customer is absent at the time of delivery, the carrier will return to the indicated address once more to attempt delivery (2 delivery attempts). If they cannot be located, Agupunt S.L. will contact you to arrange a new delivery date and time.

If three working days have passed since the order left for delivery, and delivery has not been arranged, it will be the Customer who must contact Agupunt S.L. to provide the appropriate instructions. If they do not do so, after ten working days from the order leaving for delivery, it will be returned to Agupunt S.L.‘s warehouses. In this case, the Customer must bear all shipping and return costs of the merchandise.

ORDER CANCELLATION

Agupunt S.L. may cancel an order within 48 hours after the customer’s request for any of the following reasons:

– Lack of stock

– Non-confirmation of payment

– Impossibility or shipping problems originating from the company.

In all cases, the Customer will be duly informed as soon as possible and, if any charge has been received, it will be refunded.

If you wish to cancel an order once the current sale has ended, you must proceed with its return.

RETURNS

If you are not completely satisfied with any of our items, you have the right to return the merchandise within a period of 15 working days from the date of receipt of the product. Return shipping costs will be borne by the customer, and the invoice number to which the return refers must be clearly indicated. All products that arrive in their original, unused packaging will be accepted, after verification that the merchandise is in perfect condition. Returns with open or damaged packaging will not be accepted, unless it is a manufacturing defect. Returns of custom-made items or items outside of Agupunt‘s sales catalog will not be accepted.

Once the merchandise is received in our warehouses, and after verifying its condition, its amount will be reimbursed after deducting the return shipping costs. The refund will be made according to the payment method chosen by the customer (for cash payments, the refund will be made by bank transfer to the account indicated by the Customer).

In any case, the return of defective products and erroneous shipments will be accepted, with Agupunt S.L. bearing the shipping costs, provided that the customer communicates this circumstance within fifteen days from the date of receipt of the shipment.

WARRANTY OF PURCHASED PRODUCTS

Agupunt S.L. acts as a manufacturer, distributor of manufacturers, or wholesale distributors, in the legally established terms. Agupunt S.L. informs that the contractual warranty offered is that specified by the supplier or its manufacturer, in accordance with Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users. The duration of these warranties is clearly detailed in the product description sheet.

The warranty does not include deficiencies caused by negligence, blows, improper use or handling, unsuitable working voltage or overloads, electrical accidents, installation and/or use not in accordance with instructions and not carried out by authorized Technical Service where applicable, nor materials subject to wear and tear from normal use. Products modified or repaired by the customer or any other person not authorized by the manufacturer or supplier are excluded from the warranty.

The warranty loses its value:

  1. a) If any of the data on this or the proof of purchase are modified, altered, or replaced.
  2. b) If both the identification number and the guaranteed product itself are manipulated without the knowledge of the Technical Service or the company responsible for the warranty.
  3. c) If it lacks the proof or delivery note of purchase from Agupunt S.L.

APPLICABLE LAW AND JURISDICTION

The company Agupunt S.L. and the Customer, expressly waiving any other jurisdiction, submit to the Courts and Tribunals of the Customer’s domicile for any controversy that may arise from access to the Website. In the event that the Customer has their domicile outside of Spain, the company and the Customer submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of the city of Barcelona (Spain).
